Sherrod Brown's Senate return faces $30M blitz as CLARITY Act failure triggers crypto big spenders

The crypto industry’s main super PAC, Fairshake, is ready to launch its most aggressive push to keep a legislator from Capitol Hill yet, with the $30 million it has reportedly earmarked to ensure Sherrod Brown fails in his bid to return to the Senate.

The report, which first appeared in the New York Times and confirmed by Eleanor Terrett, citing a Fairshake spokesperson, linked the revenge spending to Democrats’ role in the CLARITY Act stalling in Congress.

Why is Sherrod Brown not getting any crypto support?

Sherrord Brown has become the most prominent target of the “revenge spend” triggered by the demise of the CLARITY Act, the industry’s priority bill for setting how digital assets are regulated.

However, keeping Brown out of Capitol Hill is about more than just the Ohio seat. A win will see him reclaim his seniority and potentially the gavel of the Senate Banking Committee. While he held that seat between 2021 to 2025, Brown throttled legislation to a pace that frustrated crypto stakeholders.

Politico reported in May that Brown does not have a direct path to the seat, though as Senate Democrats’ rules tie seniority to a member’s current entry into the party conference. Restoring Brown’s standing would require the caucus to carve out an exception.

Brown is going up against Republican Sen. Jon Husted, who took over the seat after JD Vance became vice president. As Cryptopolitan reported, Husted is facing his own campaign battles too, as anti-data center lobbyists have ramped up spending to tie him to the hugely unpopular AI infrastructure sites.

Brown is going up against crypto for another election cycle

This latest bout is setting up a rematch of the 2024 election cycle between Brown and crypto interests, which committed more than $40 million into the Ohio contest. Associated Press reported that the figure was more than four times what the industry spent in any other Senate race that cycle.

Republican Bernie Moreno won that race with more than $230 million in outside groups backing compared to $154 million for Brown.

The GOP’s Senate campaign arm’s chair, Sen. Tim Scott of South Carolina, directly credited crypto funding for the win, telling a blockchain event last year. “Thank you to all of y’all for getting rid of Sherrod Brown,” per AP, adding that “literally, the industry put Bernie Moreno in the Senate.”

After losing a close 46% to 50% race, Brown has dialed back his rhetoric in his current campaign.

“Sherrod Brown recognizes that cryptocurrency is a part of America’s economy,” campaign manager Patrick Eisenhauer said in a statement to Politico, adding that Brown would “keep an open mind” as issues reach the Senate.

That change in tone has not registered with the Stand With Crypto advocacy group, which still ranks him “strongly against crypto.”

Crypto interests are loading up for this election cycle

Fairshake has the kind of financial muscle to make good on its “revenge spend” mission. The PAC opened 2026 with roughly $193 million and still held about $130 million as of August, Cryptopolitan reported, with Coinbase, Ripple, and venture firm Andreessen Horowitz supplying nearly all of it.

That sits inside a record wave of corporate money. Crypto, AI, and online betting firms are behind at least $517 million in corporate election spending this cycle, per Public Citizen data cited by Cryptopolitan, surpassing the $461 million corporations spent across the entire 2024 cycle.

President Donald Trump has said he will tap his $400 million MAGA Inc. super PAC to protect vulnerable Republicans.

The industry will be looking to avoid a repeat of the CLARITY Act’s September 15 cloture vote that failed to gather the 60 votes it needed.

These midterm elections will now decide whether the bill is revived or the SEC and CFTC write the rules instead. Voters go to the polls on November 3.
