Bitcoin falls below $75,000 as the CLARITY Act fails in the Senate — what the vote means for crypto

Bitcoin briefly fell below $75,000 on Tuesday after the US Senate blocked the Digital Asset Market CLARITY Act, in the largest one-day drop for the cryptocurrency since June. The bill — the most ambitious attempt yet to build a federal rulebook for digital assets — failed a procedural vote 49-50, roughly 10 short of the 60 needed to advance. Ethereum slid more than 8%, Coinbase dropped 10%, and the total crypto market lost about 3%, or roughly $75 billion, in a single session.

The token was last trading at $75,938, having clawed back above the round number in Asian hours, but it remains below the $78,163 close it recorded on Monday. Here is what happened, and what comes next.

The vote: 49-50, ten votes short

The Senate voted on Tuesday on a motion to invoke cloture — the procedural step needed to move the bill toward a final passage vote. It needed 60 votes; it received 49, with four Republican senators joining Democrats in opposition.

The bill would have created a federal market-structure framework for digital assets: clarifying whether the SEC or the CFTC supervises which tokens, setting registration requirements for exchanges, and tightening anti-money-laundering rules. Days before the vote, Republicans had released a revised draft incorporating 126 changes requested by Democrats, but the compromises — particularly around ethics provisions covering public officials' crypto dealings — were not enough.

Crucially, the vote was procedural, not final. A failed cloture motion does not kill a bill outright, and one senator changed his vote as a technical manoeuvre that preserves the option to bring the measure back. But the legislative calendar before November's midterm elections is tight, and Senate work on the bill has effectively halted for the year.

The market reaction: every major coin, one direction

The selloff was broad and immediate:

The losses spread straight into listed crypto proxies. Coinbase (COIN) closed 10.1% lower at $172.11, Circle (CRCL) fell 9.5% to $88.26, and Galaxy Digital, Gemini and Robinhood all fell between 3% and 8%. Part of the pressure was also plain risk reduction: traders are trimming positions before tonight's Federal Reserve decision, which is expected to deliver the first US rate hike since 2023.

Levels to watch

Bitcoin is now trading in the middle of the range it carved out in September:

A decisive close back above $78,000 would suggest the vote was absorbed as a political setback rather than a structural break; a sustained move below $74,000 would signal that the market is repricing the timeline for US crypto regulation — and, on tonight's Fed decision, for risk assets broadly.

What it means for Australian traders

For Australian readers, two things matter from here. First, the timing: the Fed's decision lands at 4:00 am AEST Wednesday, and the CLARITY setback leaves crypto markets with no near-term positive catalyst to offset a hawkish surprise. Second, the transmission is direct — Coinbase, Circle and the other listed proxies are all tradable on the platform, and their moves tend to amplify the underlying token price in both directions. The bill itself is not dead — it can be reconsidered when the Senate returns to it — but the window before the new Congress wipes the slate clean extends only to early January.
