Why CFTC's Federal Option for Centralized Exchanges Just Got Harder to Ignore

Commodity Futures Trading Commission (CFTC) Chairman Michael Selig’s voluntary “federal option” for exchanges has a new selling point. An attacker drained about $6.36 billion from Binance in roughly 20 minutes this week, TRM Labs says, and no federal rule stood in the way.

Three weeks ago, the option was a policy footnote. Today it is the only federal answer to the question every exchange customer is asking. Who stands behind the money?

What the CFTC Federal Option Actually Offers Centralized Exchanges

Selig pitched the plan on earlier in the month, after Congress stalled the Clarity Act, the bill that would have forced every exchange to register with his agency.

Without that law, he cannot compel anyone. So the CFTC published a proposed crypto rulebook and left the door open.

The deal is simple. An exchange that walks through must keep customer money separate from its own and follow federal anti-fraud rules.

In return, it may offer US traders leveraged trading, meaning bets placed with borrowed money, under rules state payment licenses were never built for.

“The American people deserve clarity, certainty, and consumer protections in the crypto asset markets,” Selig stated.

His proof is FTX. Its founders misappropriated roughly $8 billion in 2022, yet the one FTX unit registered with the CFTC kept client assets intact, Selig said on October 5.

Where the Federal Option Still Falls Short

Binance exposes the limits. Its global exchange does not operate in the US, so the rulebook would never have reached it. Binance says it will cover every loss, with about $3 billion already frozen, per its own disclosures.

Nor does the option stop a break-in. Rules about where customer money sits do not block a stolen login, which is how Binance says the attacker got in.

Comments on the CFTC plan close around mid-December. Until an exchange signs, customers rely on the balance sheet of whoever holds their coins.

Whether Coinbase, Kraken, or any offshore player takes Selig’s deal will show if a voluntary rulebook can move that money somewhere safer.
