Former Super Micro Contractor Pleads Guilty in $2.5 Billion AI Server Case: What Risks Does SMCI Stock Face?

TradingKey - On October 9 ET, according to Reuters, former Super Micro Computer (SMCI) contractor Ting-Wei "Willy" Sun pleaded guilty on October 8 in a Manhattan federal court in New York.

The case involves the illegal transshipment to China of servers equipped with advanced Nvidia AI chips. The report did not disclose the specific charges or terms of the plea agreement.

Case Involves About $2.5 Billion in Server Procurement

On March 19, U.S. prosecutors announced indictments against Sun, Super Micro co-founder Yih-Shyan "Wally" Liaw, and Ruei-Tsang "Steven" Chang, general manager of the Taiwan office, alleging that the three conspired to violate U.S. export control regulations.

According to prosecutors, a Southeast Asian company procured approximately $2.5 billion in servers from the manufacturer involved between 2024 and 2025, after which a large volume of controlled servers was subsequently diverted to China.

From late April to mid-May 2025 alone, the value of servers allegedly illegally diverted was at least approximately $510 million. The $2.5 billion figure represents total procurement, and the announcement did not separately detail the full amount actually diverted.

Company Completes Internal Investigation and Discloses Cooperation With Government Probe

Super Micro announced on August 20 the findings of an internal investigation led by independent directors, stating that it found no evidence that senior management in office at the time was aware of the relevant transshipment schemes, nor evidence of the company directly selling controlled products to known restricted entities or locations.

The company stated that it had taken personnel actions, including terminations, and begun implementing export compliance enhancement recommendations. The three individuals involved are no longer associated with the company, and the company was not named as a defendant in the March criminal indictment. The company also stated at the time that it was continuing to cooperate with investigations conducted by relevant government agencies.

What Risks Does SMCI Stock Face?

On October 9, SMCI closed at $41.86, down about 2.1%. Reuters reported on the guilty plea developments after the market close that day, so the day's decline cannot yet be directly attributed to the news.

The report made no mention of the guilty plea causing order reductions or delivery disruptions. If subsequent investigations increase the company's legal risks or cause legal and compliance expenses to rise, earnings expectations and valuations could come under pressure.
