EU Gives Crypto Exchanges 3 Months to Drop Unauthorized Stablecoins: What Happens to USDT?

Crypto exchanges in the European Union have until January 8, 2027, to stop offering unauthorized stablecoins. Regulators also say warning customers about the risks will not count as a fix.

The order names no token. However, Tether (USDT), a dollar stablecoin issued by El Salvador-based Tether, has no approval under EU rules.

What EU Exchanges Must Switch Off by January 8

The European Securities and Markets Authority (ESMA), the EU’s markets watchdog, set the deadline in an opinion published Thursday.

It applies to every licensed crypto firm under the Markets in Crypto-Assets Regulation (MiCA), the EU law governing crypto companies and stablecoin issuers. Trading, custody, transfers, and investment advice all fall in scope.

Firms must block EU customers from buying more of any stablecoin that fails MiCA’s requirements. Existing holders keep a way out. Until the deadline, they can sell, convert, withdraw, transfer, or store what they already own.

ESMA also ruled out disclosures as a defense.

“ESMA considers that reliance on warnings, disclosures or client acknowledgements would not sufficiently address the concerns identified in this Opinion,” read an excerpt in the opinion published Thursday.

The opinion is guidance for national regulators, not a new law. ESMA said it will monitor how each country applies it.

Where Tether Stands as the Clock Runs

Tether has never secured authorization under MiCA, the regulation that tells big issuers to hold at least 60% of their backing in banks.

Tether keeps most of its money in US government debt. So it let USDT get dropped by EU exchanges rather than change. CEO Paolo Ardoino objects to the MiCA bank-deposit rule.

In contrast, rival issuer Circle holds a French license for its USDC token, granted in 2024. Circle has since backed a MiCA fix that could let Tether return. The idea, termed equivalence, would let the EU accept the home rules a company already follows, with no separate EU coin needed.

“Equivalence is emerging as a compelling alternative to the multi-issuance model, currently the only possible regulatory pathway for these global stablecoins under MiCA,” said Patrick Hansen, Circle’s head of EU policy.

Tax rules are moving too. Greece published a draft bill on Thursday for a 10% tax on crypto gains above €500 a year. The bill goes to parliament in November.

Greece currently has no full framework for taxing crypto. Across the EU, rates range from 8% to 30%, with no common system.
